The owner of a Monte Sereno home noticed that the backyard pool was being drained but assumed that the contractor renovating the home was doing so.
The contractor assumed that the homeowner had asked a pool company to drain it for some reason.
"It didn't raise any suspicion," said Deputy Terrance Helm, Santa Clara County Sheriff's Department spokesman.
They later found out that an unauthorized third party was responsible when two Santa Cruz County men were arrested after they were caught skateboarding in the pool.
The two men, 29-year-old Brian Starn and 25-year-old Beau Godfrey, were arrested at the home in the 18000 block of Daves Avenue March 13 at about 4 p.m. The homeowner, who is not living in the home during the renovation, had arrived earlier to discover the men. They admitted to trespassing and skateboarding in the pool, causing an estimated $11,000 in damage from gouges to the pool floor surface. The men have been charged with vandalism, trespassing, possession of a police baton and cocaine possession.
Helm said Starn and Godfrey might be the ones who drained the pool, though, according to Helm, they claimed that a friend told them of the empty pool. A sump pump was found in their vehicle, and they were wearing clothing that read "Blue Ribbon Pools," but both men said they did not work for that company.
A burglary was reported on Feb. 6 when a hole was discovered cut into a temporary fence around the house. Another incident of trespassing and vandalism was reported March 6, but no one was caught.
